Big Brain Funding is not a lender. Completing the assessment is not an application for credit, and nothing on this site is an approval, an offer, or a guarantee of funding. Only a funding provider can approve or decline financing.
These Terms of Service govern your use of bigbrainfunding.com (the "Site"), operated by Latam Resource Group LLC ("Big Brain Funding", "we", "us"). By using the Site or submitting an assessment, you agree to these Terms. If you do not agree, please do not use the Site.
1. What we do
We provide an informational assessment that organises details you supply into a preliminary funding profile, and — where you consent — introduces you to third-party funding providers who may be able to serve your situation.
What we do not do
- We do not lend money or provide capital.
- We do not make credit decisions, underwrite, or approve or decline applications.
- We do not set or negotiate rates, fees, terms, or repayment schedules.
- We do not act as your broker, agent, advisor, or fiduciary.
- We do not provide legal, tax, accounting, or financial advice.
2. The assessment is not an application
The preliminary profile produced by the assessment is an informational summary based only on unverified answers you provide. It is not an approval, a pre-approval, a commitment, an offer of credit, or a guarantee that any provider will contact you or extend financing.
Final eligibility, amounts, rates, terms, and documentation requirements are determined solely by the funding provider, following its own underwriting. Any figures, ranges, or categories shown on the Site are illustrative and are not quotes.
Submitting an assessment does not cause a credit inquiry. Credit information you give us is self-reported and unverified.
3. Eligibility
You may use the Site only if you are at least 18 years old, are located in the United States, and are the owner of — or are authorised to act for — the business you are submitting information about. The Site is for business and commercial purposes only. It is not for personal, family, or household credit, and consumer credit protections that apply to personal lending may not apply.
4. Your responsibilities
- Provide information that is accurate, current, and complete. Inaccurate information produces a meaningless profile and may cause a provider to decline you.
- Submit information only about a business you own or are authorised to represent.
- Do not submit another person's information without their permission.
- Do not use the Site unlawfully, to submit false or fraudulent information, to scrape or harvest data, to interfere with its operation, or to attempt unauthorised access.
5. Third-party funding providers
With your consent, we may share your profile with one or more funding providers, brokers, or partners, who may contact you directly.
We do not control, endorse, guarantee, or assume responsibility for any funding provider, or for the products, rates, terms, conduct, or communications they offer. Any agreement you enter into is solely between you and that provider.
Review every offer carefully before you sign. Business financing products — including merchant cash advances and short-term products — can carry costs substantially higher than conventional loans. We strongly encourage you to read the full contract and consult your own legal, tax, or financial advisor.
6. How we are compensated
We are paid by funding providers for introductions and marketing, typically per accepted profile. We do not charge you a fee for using the Site or completing an assessment.
This creates a financial interest in connecting you with a provider. We disclose it so you can weigh it. It does not mean any particular provider is the best or cheapest option available to you, and you remain free to seek financing elsewhere.
7. Communications
If you tick the consent box, you agree that Big Brain Funding may contact you by phone, email, or text message about business financing, including through automated technology. Consent is not a condition of any purchase. Message and data rates may apply and message frequency varies. Reply STOP to opt out of texts, or use the unsubscribe link in any email. 8. Intellectual property
The Site, including its text, design, logos, and branding, is owned by Latam Resource Group LLC and protected by intellectual property law. You may view and print pages for your own business use. You may not copy, republish, resell, or create derivative works from the Site without our written permission.
9. Disclaimer of warranties
The Site and all content are provided "as is" and "as available", without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure, that any information is accurate or complete, or that you will be contacted by, matched with, or approved by any funding provider.
10. Limitation of liability
To the maximum extent permitted by law, Latam Resource Group LLC and its officers, members, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any lost profits, lost revenue, lost business, or lost data, arising out of or relating to your use of the Site or any dealings with a funding provider — even if we have been advised of the possibility.
To the maximum extent permitted by law, our total aggregate liability arising out of or relating to these Terms or the Site will not exceed one hundred US dollars (US$100).
Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
11. Indemnification
You agree to indemnify and hold harmless Latam Resource Group LLC and its officers, members, employees, and agents from any claims, liabilities, damages, losses, and expenses — including reasonable legal fees — arising out of your use of the Site, your violation of these Terms, your violation of any law or third-party right, or any information you submit.
12. Changes and termination
We may modify these Terms at any time by posting a revised version with an updated date. Material changes take effect when posted, and your continued use means you accept them. We may modify, suspend, or discontinue the Site, or restrict access, at any time without notice.
13. Governing law and disputes
These Terms are governed by the laws of the United States and of the state in which Latam Resource Group LLC is organised, without regard to conflict-of-law principles. You and Big Brain Funding will attempt in good faith to resolve any dispute informally by contacting us first at the address below before commencing any formal proceeding.
14. General
If any provision of these Terms is held unenforceable, the remaining provisions stay in force. Our failure to enforce a provision is not a waiver of it. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Site. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
